Mutton Fish Tours Cancellation Policy and Waiver

Mutton Fish Tours has a 24 hour, 100% cancellation policy. Guests may cancel the excursion for any reason prior to 24 hours of the excursion departure time at no charge. Any cancellation received WITHIN 24 hours of the scheduled departure time or any no show on the day of the excursion is subject to 100% cancellation/no show fee and no refunds will be authorized.

Group bookings of a minimum of 10 guests to a max or 29 guests have a 7-day cancellation policy. This means any groups of this size must cancel their reservation PRIOR TO 7 calendar days in advance of their excursion date. Any cancellation received WITHIN 7-days of the scheduled excursion date or any now show on the excursion date is subject to 100% cancellation/no show fee and no refunds will be authorized.

Group bookings of 30 guests or more, or exclusive buyout bookings, have a 14-day cancellation policy. This means any groups of this size or nature must cancel their reservation PRIOR TO 14 calendar days in advance of their excursion date. Any cancellation received WITHIN 14-days of the scheduled excursion date or any no show on the excursion date is subject to 100% cancellation/no show fee and no refunds will be authorized.

In order to ensure on-time departures, Mutton Fish Tours enforces a strict wake-up call two hours before departure followed by a check-in call one hour before departure.  

Any guest who has not answered their wake up and or check-in call on the day of their excursion forfeits their seat and is subject to the tour’s 100% cancellation fee, and will be deemed a “no-show” guest.

Mutton Fish Tours reserves the right to make cancellations based on unexpected weather conditions or other reasons deemed acceptable by its operators.

All cancellations from guests MUST be received by email or phone call and or WhatsApp message noting the particulars of the reservation and the reason for cancellation.

Mutton Fish Tours is not responsible for any information obtained via a third party.

Mutton Fish Tours is a registered company in The Bahamas officially licensed as Mutton Fish Company Limited.

Mutton Fish Tours is not responsible for any lost or stolen items.

Although Mutton Fish Tours is capable of handling minor emergencies, we are not responsible for any personal property or injury to guests while on the excursion.

There are no weather-related refunds if Mutton Fish Tours operates the excursion. In the event that Mutton Fish Tours deems the weather as unsafe and or there is a mechanical failure of equipment and Mutton Fish Tours cancels the trip, the guest will be able to reschedule their excursion or receive a full refund.

Mutton Fish Tours is not responsible for any credit card or bank fee charges.

All activities are weather-permitting. Mutton Fish Tours cannot guarantee that all activities will be available and reserves the right to decide whether to offer a particular activity on a given day based on the safety of our guests and staff.

If a booking is made with a credit card over the phone supplied to Mutton Fish Tours by the guest, Mutton Fish will send a confirmation via email/text and or WhatsApp message to the email and or number provided by the guest.

If the guest replies to the email confirming the booking, the guest in doing so also agrees to the terms and conditions of the booking and acknowledges that the credit card information was voluntarily given on their own free will to make the reservation and releases Mutton Fish Tours from any charge backs, refuses, or merchant disputes in the future.

Mutton Fish Tours reserves the right to charge guests a 50% deposit. This deposit is refundable in the event Mutton Fish Tours cancels the trip due to weather and or mechanical/equipment failure. This deposit is NOT REFUNDABLE in the event guests are a no show and or cancel for any reason before or during departure.

Guests understand that there are inherent risks involved with a private island destination, including but not limited to equipment failure, perils of the sea, harm caused by creatures (including bites), acts of fellow participants, boarding or disembarking boats, entering and exiting the water, walking around the island, climbing and descending stairs and all other activities and I HEREBY ASSUME SUCH RISKS.

Shark Clause:

Guests understand that Mutton Fish Tours is not responsible for their safety and well being should they enter Bahamian waters bleeding from an injury and or menstruation; nor is Mutton Fish Tours responsible for their safety in the event they bleed from a minor cut or wound and fail to vacate waters immediately.

Mutton Fish Tours Waiver

I agree to sign the following waiver to participate. 

I acknowledge and agree that

  1. my contract with Mutton Fish Tours and  
  2. any and all disputes or issues arising between you and Mutton Fish Tours relating to your contract with Mutton Fish Tours or in any other way connected to your excursion with Mutton Fish Tours are exclusively governed by the laws of the Commonwealth of The Bahamas and are subject to the exclusive jurisdiction of the courts of the Commonwealth of the Bahamas.

This waiver is made and entered into in The Commonwealth of The Bahamas and shall in all aspects be interpreted, enforced and governed by the laws of The Commonwealth of The Bahamas.

The Parties agree that the Courts of The Commonwealth of The Bahamas shall have exclusive jurisdiction to determine any dispute in relation to the Waiver.

THE ISLAND IS NOT HANDICAP ACCESSIBLE.

This tour is “Soft Adventure”, which is described as outdoor or recreational travel undertaken to remote or non-traditional destinations for the purpose of new experiences, exploration of cultures and natural wonders or engaging in a variety of rugged activities.
